I have to be a police witness against my husband who domesticaly abused me. the police said that I needed to go to court or I’ll get arrested. But my husband’s solicitor said that if I don’t show up as their witnesss the magistrate will automatically dismissed the case? cause the police have no witnesses, will the police then supponea me to attend court another day?
I haven’t been summons to go.

    If you are a material witness in a case, and do not show up, the judge will issue what is called a material witness order, which basically gives the police the authority to force you into court.

  6. The only way you would get arrested is if you got a Summons and didn’t show. But if your husband is beating you, you should testify against him, he deserves what he gets.

    Yes, and you will get arrested. You have already been served with papers to go. This is no laughing matter, you need to go. Do you want him to beat you worse the next time he gets the chance. He needs to know this has to stop.

  9. If the police have warned you that you will be arrested if you don’t attend court, I’d listen to what they say and attend. I think that the solicitor is just trying to intimidate you into not attending so the case will collapse. If this happens, then your husband could be released, and may return to continue his abuse. Could you cope with this? If you attend, this will show your husband that you’re not willing to simply put up with his abuse any more, and will make you stronger.

    Please stand up for yourself and attend the hearing. You’ll feel better for it! Don’t let fear rule your life!!

  11. i would ask if there is any way you could give evidence from a different room or from behind a screen i think its important that you go and see this through this guy has obviously hurt you in some way do not let him win how would you feel if because you didnt go through with it next time in his new relationship someone is really hurt physically or emotionally and it ends up fatal. this guy is a bully and will stay that way until you show him enough is enough you will be quite safe go and handle your business and hold your head high, dont let him see you cry..

    Good lord. If your husband beats you why on earth shouldn’t you go? Of course I pretty much gave up on humanity ages ago. I hope there aren’t children involved.

  13. Yes you have to go, but you do not have to testify against your husband, Its call spousal privilege. They can not make you, as long you were married when the incident occurred.

    If your court case in Canada you defintly will have to show up, considering your one of the main witnessess to testify. If you don’t show up the judge will issue a warrant for your arrest and you will be charged with either contempt of court or obstructing justice. Regardless you can be held either a) for the remainder of the trial or b) 8 days in jail, whichever is sooner. Just show up, testify and get it over with.

    YES and YES. If you are scheduled to attend court and fail to appear, the judge will issue a bench warrent for your arrest. Once arrested you will be fined and must pay that fine. Since you are the only witness in this case you will have no choice to appear. You can however decide that you want to drop charges at the trail and that will end the case or go ahead and testify to what happened.

  16. ye sthey will make you go to court if you dont show up they will jsut get a order from the court to supponea you.. if you want to back up when you go testyfy just tellthem there nothign to say abotu thsi and you dont want to keep on with it u drop all charges if that is want u want… btu if he abused you he does deserve to be behind bars…

    If you’re trying to "stand by your man", things may not go like you plan. First off, you’ll probably get that summons in the mail soon because you’re the victim and witness . Once summoned, the court can require a wife to give evidence against her husband for crimes against her person. If you refuse to testify, the court may find you in contempt of court. If you do not show up for the trial, the court may issue a warrant for your arrest. Laws vary from state to state so your best bet would be to consult an attorney.
