I’ll give the background info –
in ’99 i became ill and went to three gp’s and went to the local hospital twice. I was either told I had a ‘two yr virus’ or they insinuated I had an eating disorder (which i denied as i didnt)
In ’02 a doctor finally found that i had 3 brain tumors and i underwent emergency surg. As a result of this I now have several disabilities including no longer being able to smile – im 27.
The doc who found my tumors said that if they’d found them earlier the chances of me having these disabilities would have significantly lowered or not at all. I was about a wk away from becoming unconscious. this doc said i shld seek legal advice and that he wld bac me up. To cut a LONG story short, I sought legal advice, had a solicitor promise me i’d get what i deserved requesting that i only pay the doc fees. Im on a disability pension so this was extremely hard. Thousands of dollars later, none of the doctors wld help me, even the one who said he would. I believe I deserve some kind of compensation. I cldnt work and still cant. I know that my time period for suing is expired now but why was it so hard. People sue for the silliest things and win and im thousands of dollars out of pocket. I just want a legal point of view – i live in australia…..

Unsuccessful? 3 brain tumors sounds like a pretty reasonable reason to be unsuccessful. Don’t pay the hospital bills, what are they going to do? Sue a person with zero income whom they just disabled due to negligence?

    2. contact legal aid. As for you deserving some form of compensation, all depends on your case, each case is different, and proving that they were negligent is a very difficult thing to do, as you would have presented with many symptoms etc.
But your first step is legal aid, they will be able to point you in the right direction, either taking on the case themselves, or being able to refer you to a lawyer who works pro bono.
