i broke up with me ex about 2 years ago we own a house together and he wouldn’t sell i could afford a lawyer and legal aid wouldn’t help me….. is it worth my while to legal get it divided in the courts he kept all of belongings and has never paid me a cent in maintenance for our 3 year old daughter….. also he rarely ever see our daughter exept to try and control me and to hurt me she has gone to hospital i have called him and he does not Visit…. when he decides he wants to see her its only for like 12 hours every 4 months or so…. he does pot and is very aggressive he use 2 beat me with her in my arms he has another child that he does not see and hasn’t for about 3 years what are my chances of getting sole custody of my daughter..
we were not married but my name is on the deeds to the house and home loan
when i left him cops were called for a domestic and removed us from the house…..but i never filed a offical complaint

    1. This is quite a serious question, but before any of us can give you the accurate and legal answer, we need to know if you are married to this man. If you are looking for a proper answer, you must tell us if you are married.

      O.K so you were not married to this person, and yet you had children with him. I will never understand that scenario. You say that your name is on the deed to the house and that you are mentioned on the loan note. If that is the case then you own half of the equity in the property, in other words, you own half of the house. If the house is offered for sale, both of you will be required to be a party to the sale.. The father of your children will not be able to sell the house without your permission. Also remember that if he reneges on the loan payments, you will be called on to make the payments. Should the debt go bad, it will reflect on your credit standing as well as his..
      As far as visitation rights and if you can get sole custody of the children, that is a matter for the courts. You will have to make application via your child services office where you live. Every town and county has such an office, they may call it something else but it is there.
      For the rest of you ladies reading this, when a man has children from a previous attachment and he neglects them, why do you think that it will be any different for any children that he has with you. I have been a lawyer for more years than most of you have been alive and have seen this sort of mess more times that I can count, I have never met a man that can support more than one family, remember that fact.
