have aproblem with the will of my friends parent, not yet passed away. they and one of their siblings are the attorneys of thewill of parent. one sibling carries on when they need something eg cash. and does so until parent gives in when they have told them not to. i am afraid they – sibling will contest the will after the parent dies. they were all okay about the property and what was written in will when it was made. this sibling will get something out of this and I so scared for this friend that they will get nothing and lose everything they have earned. this friend looks after the parent and cares for them and yet works and helps out as much as possible. They have a solicitor, but is there any suggestions? Please assist.

It’s against my integrity, but would the judge see it differently?
Do they do this anymore?
NSW Australia law only please.
(not sure which section this should be put in sorry)
RE: I may have to go to court soon in regards to my kids & their lying father. We had a mediation conference in February & he has since put in things that arent true & are ridiculous, so my solicitor is writing back to say I dont agree, so it may go to court. I’m really scared because I dont want to lose my kids and currently have 100% care of my oldest (there are 4 other siblings whom he is the father of as well – so 5 in all).
My belief system is really important to me. Please dont say it’s just a book either.
The bible is more than just a book to others & I’m sure they see it as equally important (which is why I asked not to say it’s just a book!). This isnt meant to be a religious argument. If someone feels the need to make those comments, then please go to the R&S section under Society & Culture, NOT here. This is a serious question!

My mother’s will is equally divided between 4 siblings and 1 is making a claim that he paid off her house, which is not true as I have all the reciepts and the same solicitor that wrote the will also dealt with the house sale in 1952.
If you are a lawyer or have been in a similar situation please advise me on what to do. Thanks.

My mother has passed away and it appears without a Will (intestate). I have searched both at home, friends, banks and solicitors.
There are two siblings me and my half brother. There are no other family members. He has not been part of her life for about 50 years. There was some kind of fall out. He has sent birthday and Christmas cards but no other contact. I on the other hand have been very much involved in my mother’s life.
Now I understand without a Will the estate will be split equally between us. I am having a hard time thinking that he is entitled to 50% when I don’t believe he is worthy of it.
I know you can dispute it when there has been a Will but what if there is no Will.

Mum died. The executor (Public Trustee) did EVERYTHING wrong. I then started getting calls from relatives…harassing and hang up. Threats because I was supposedly going to court. I had not even seen a solicitor! All lies. Then a brother got a letter from a solicitor saying I had started legal procedings. I hadn’t. So I had to go to a solicitor after a year of this abuse.
He did nothing much I asked about stopping the abuse. Seven months later, he, without my permission, applied for me to take the inheritance that my siblings (and I) were to share.
I had always said NO COURT.
Now solicitor is fired…madman…and I need help to undo a court matter that even the court house refuses to take off the list.
If I proceed, with or without a solicitor, and loose, I have to pay all the legal fees that everyone accumulates. The looser really looses. The inheritance will be totally gone, and I will be in debt if this happens.
This is URGENT.
Newcastle NSW.
I’ve tried the phone book…it’s about 30 solicitors I’ve tried…not their field, not local enough, nasty, too expensive, can’t see the problem…you name it…..too many excuses why no one wants to fix a problem !
