Ok.. here’s the scenario..

We met and within a week were intimate.. we decided a month later to live together and then for the next 6 years were in contact dialy.. not a day went by that we didnt talk..

My girl at the time had no assets and a basic job paying K.. I was an executive, living near the beach I owned a business was earning six figures and drove a new BMW..

6 years forward.. she runs off one day.. only a week after I had relocated my office and life 500 meters from her family home.. i have never seen her since !!

I then heard she was preganant and already married to another guy !!

so clearly she cheated me clearly..

but she denies it all.. she has told everyone we had broken up years ago.. but i have proof we were still living together .. thats easy to prove..

i can also prove i spent 0,000 just in food, bills and rent as we lived either 20 meters off the beach or somewhere with sweeping city views for 6 years.. and i usually paid all the bills and most of the rent.

we also had businesses together.. and i had registered one in her name.. as we planned ot marry so she was gonna work it while pregnant.. how convenient.. she took that too and no doubty is working it now with her new husband.. she stole everything i owned in that business.. including stuff she aasked to borrow only weeks before dumping me suddenly..

i now lost my company and am unemployed living off my savings..

meanwhile.. she is living a comfortable life now.. and is rich.. married and already has kids..

i am still stuck 500 meters from her parents home !!

i can sew her under de facto laws but no solicitor seems ot be interested..

does anyone know my rights here.. coz this feminist has completely robbed me.. and she did it with a smile on her face.

From the end of Sept until mid Nov 2009, I knowingly and willingly lent him ,605 in 10 cash payments. During this time, he paid back ,610 with 5 personal cheques, all of which were dishonoured. The only proof I have that I lent him money are the dishonoured cheques, my bank statement showing large cash withdrawals, as well as text messages back and forth acknowledging and arranging payment. Since then and up until May 14 (when his phone was disconnected), communication was still open, but pointless, as any arrangements for the money to be returned were cancelled or simply blown off. He gave me many excuses and stories, I’ll bring it tomorrow, I get paid next week, I’ll drop it in tonight etc. I suspect he’d been stringing me along with no intention of paying me back: a con-man. I prepared a statement and took that, along with copies my "proof", to the police. They said it was a civil matter, not criminal, and I should contact a civil lawyer for advice, and that I could get free representation through legal aid. How do I go about doing that? Do I just phone my local magistrates court (Ringwood), or do I contact Victoria Legal Aid (Ringwood branch)? What procedure do I need to follow?

my car was stolen two yers ago. i had a full com. ins. with direct line. after a month of investigations i was offered a setllement figure which i accepted. after a week insted of cheque i was sent a letter saiyng that my claim was fraudulent and there fore its canceled. they sad that there records showed that i have newer sent them my 5 years no claims bonus proof on my previous policy and that i still owe them £650. And because that was not setlled i was not cowered by current policy so they dismised the claim. this car was on finance and i had about £10000 outstanding. i contacted them saiyng that i have sent the proof and they never told me before that they dindnt recieved it. they can also check themselfes with the other companys to confirm my no claim bonus so i dont believe that they have a right not to pay me’ since this happened i was going downhill; my credit history is ruined and defaulted. i still had to pay to finance company but i couldnt. i cant afford solicitors. now i cant borow even a fiver from banks so if any one has some advise pls let me know. thanks

Well this is just for some advice for my friend. shes not on this site, so thought id tell the story and see what people think or know of that can be done.
Basically can only accept australia residents answers cause its about law and i know every coutry is different, but please state where you are from, even if you are out of the coutry and you want to give advice, just so i know what can be done.

Anyways, my best friend has a 15 month old. Herself and her ex broke off the relationship (of 2 years or so) about october 2007 (when the baby was 5-6 months old. They fought through court over custody(from applicationt to final settlement was 7 months), she was happy to give him visitations, but just wanted it to be written and witnessed by someone in the law field. Just for proof and what not. The solicitors suggested that the father have the child every weekend, as he had not been around for a while due to them breaking up, and that in doing this, would give the child more time to get to know his father and realise that weekends are dad time. He was not for this, agreed on ever second weekend and then it was settled. He wasnt too into the whole "visitation" thing, and as everyone could clearly see, he only agreed to court to spite my friend and make her upset.

anyways he was taking the child every second weekend. well nearly. Alot of the time he was ringing saying "oh i have something on this weekend but can i have him a night during the week". She was very leiniant and was good with him switching days, just so her son could spend time with his dad. Anyways, its been probably just 3 months, and the father has slacked off bigtime. He keeps trying to switch his weekends for week nights (only because he wishes to party and get drunk). And what is worse, is he lies about it.
Now this is where it started to get out of hand. this weekend just gone, it was the fathers turn to take the son, He usually comes friday arvo, picks him up and takes him back home sunday arvo, But this week he wouldnt give my friend an answer. Kept saying he might have to "work". He text messaged her friday afternoon and said sorry i have to go on a business trip for work and ill be out of the state. She rang his work (where he claimed to be employed) and they stated he hadnt worked there in years. She was soo mad at this point and caught on he was lying, she drove to his house. She found 6 or so cars, music playing and people hanging aorund drinking. she got out the car, stormed inside and found him drunk on the lounge. she yelled at him (wont tell whole conversation) and left. He hasnt contacted her since!!
She rang legal aid, and her solicitor who is through them, and asked what can be done. they said NOTHING! He does nto have to take his son if he doesnt want to. BUT the strange this is, if now she hesitates to let him go there (eg the father wants him on his next weekend and she says no) she will be in trouble for it, and could be punished for, i suppose, going against the agreement. And now she doesnt know what to do, as she is upset the father does not want to see the son (chooses partying over seeing is son) and is worried he has parties while he has his visitation!

was just asking for advice on what i can tell her to do?
she is planning to ignore him, hoping he takes her to court, and she can then stand infront of a judge and show all the proof of his lack of enthusiasm and his lies (as she has a diary).

I have documented proof of police inconsistencies and outright lies. Legal Aid has declined to help, thanks to a type-o in a legal document issued by the court appointed solicitor. The case is huge and ,000 wouldn’t cover the costs. So self representation is the only door left open. My problem now is the utter lack of information on navigating the rabbit warren of Australian laws, rules, regulations, limits and boundaries. Every door I’ve knocked on responds negatively and is closed quickly. For all the "no’s" and "it dosen’t work like that’s" I have endured so far, I am becoming more determined to be heard. Because nothing is impossible, I will not be drawn into this worlds hypermaterialistic negativity. From what i’ve been told by "professional’s" the truth is not important, it’s just a money game. Well, I’ve been nominated for a game, but I have no money. Can anyone help me? Surely I am not the first to endure this diversion of reailty.

If so, then which person has to provide proof?
