Question for Aussies who know the law.
Okay, long story. I only have two points left on my license because of four speeding tickets I’ve had in the last few years. Yesterday, in the mail, I got another ticket on which I lost three more points. This takes my total to minus one, but that shouldn’t come into effect until after I pay the fine, as far as I know.
So, I have a few questions:
1. Is it right that the points won’t be actually lost until the fine is paid? I’m fairly sure, but is anyone 100% certain?
2. Can I pay extra and just use my license for work? I’ve heard that people who have been caught for DUI can do this, so does it also apply to speeding fines?
3. If I get a license that will enable me to go to and from work, will it also enable me to drive while I’m at work? A small part of my job will involve driving people around to different places.
4. I found a bit later on the Legal Aid website that the Dept. of Transport write to people who use up all their points, and offer them either a 3 mth suspension OR a 1 yr good behaviour period. Here’s the website:

It seems that it’s okay to drive until I get the letter from the Dept. of Transport. Is that correct? Anyone know for sure?

I have two sons to my ex husband. I am in a situation where my two kids are supposed to go to their dads every 2nd weekend and half the holidays but they seem to go when they feel like it now because my sons are 17 and 15 years old. The problem is with the new legislation in the child support agency going on how many nights they are in mums care and dads care. My ex according to the court order has the kids 21% of the time and I have them the rest. But the kids are not working with the court order. I have told the child support agency this and I have asked my ex by sms to tell them the truth because I do not want to go back to the family court and change orders when I know I may in court for the next 2 years. How would I cover the legal costs if I do not have the money and cannot get legal aid. I need my ex to do the right thing now by our sons.

I was abused at a dyslexic school in Suffolk in 1997. A conviction of 6 years was reached for the abuser at the Ipswich Crown court. And was awarded 12,000 pounds for mental anguish, and my mother father were also given 12,000 for lost school fee’s and air fairs, but what they claimed for was 50,000. However I feel that 12,000 pounds is not enough, to make up for my lost childhood. I have been trying to find out if I have recourse for a seconder claim. And have been using a well known law firm ( small but well known ) but have been very unhappy with there service. In 8 months all that has been done is write too the old school and that is it. (I found out >>)The school was sold in 1998. The lawyer told me, it was most likely that there was nothing too be done. However I tracked down the ex-owner myself from Australia as well as the school’s lawyers at time, I also had to hire a PI to help confirm my finding. I don’t feel I should have had to do this, as I am the client. They ignore my questions and instructions regarding my case. And for every 6 emails I send them I get one very short one back. I am doing more running around here in Australia then they are in the UK. Now ….know one knows if a full and final statement was ever sighed. As I was 13 at the time. My lawyer’s legal aid said she did not think it would be a problem if it had been sighed as I was under the age of 18. A media exclusion contract was sighed ( it was for 5 years ) but that is all, that my mother and father can remember, witch they felt forced to sigh as it was. We did not have proper legal advise, having been recommended to a firm, but where told they would not take on the case, but would be there in a supportive roll only. Funny they still sent us the bill! We found out some time after that they were not child abuse experts and were more corporate lawyers then anything. All our documents where lost when we moved to Australia, witch has slowed things down. However the old school lawyers have full copy’s, witch my lawyers are meant to be requesting, but it has been 2 weeks and has heard nothing at all.
I am now 25 , MY Lawyers contacted me via facebook , asking for info on abuse of a school by the same name but in Norfolk. I was with in my statute. And my mind had only just turned to litigation.
I have written to 8 different abuse claimant lawyer firms to ask for a second opinion . Is there anything more that I should/ could be doing ???

i broke up with me ex about 2 years ago we own a house together and he wouldn’t sell i could afford a lawyer and legal aid wouldn’t help me….. is it worth my while to legal get it divided in the courts he kept all of belongings and has never paid me a cent in maintenance for our 3 year old daughter….. also he rarely ever see our daughter exept to try and control me and to hurt me she has gone to hospital i have called him and he does not Visit…. when he decides he wants to see her its only for like 12 hours every 4 months or so…. he does pot and is very aggressive he use 2 beat me with her in my arms he has another child that he does not see and hasn’t for about 3 years what are my chances of getting sole custody of my daughter..
we were not married but my name is on the deeds to the house and home loan
when i left him cops were called for a domestic and removed us from the house…..but i never filed a offical complaint

Thank you for your useful reply, syzygy. It helps me a great deal, but my question was actually directed to Australians who know the law. I have been driving for over 25 yrs without having an accident, and no-one with any brains believes that speeding causes accidents.
Hopefully I’ll get some replies that actually answer my question/s.

My partner and his ex split before their daughter was born. She is turning 6 in July and has always lived about five min away. My partner is a shift worker so they have never had any formal custody arrangements though despite him asking fairly regularly to see his daughter the ex often says no (mainly due to an issue with me). His ex has now informed him that they are moving about 4 hours away. We don’t have much money but earn too much for legal aid. Is there any way that arrangements can be made without going through the courts. After previous issues that we have had with the ex I strongly doubt that she would just be in agreeance if they were to talk.

Long story short: every since I was a little kid growing up I always used to get cash in the mail from relatives (particularly my grandmothers) every birthday and christmas. My mother used to deposit this money in a savings account, and eventually it accumulated to well over 1500 dollars. In late 2007 there was a divorce and it’s still going through the family court. I now live with my dad and havnt seen or talked to my mother for nearly 2 years. I have always been aware of this money given to me by my various relatives, but I have never really cared about money until recently; I have gained a need for this money which should rightfully be mine since it was given to me.
I originally contacted her by email last week and requested the money, but after a chain of emails going back and fourth between us, she is refusing to give me the money until I "start behaving." What she means by that is that I stop refusing to see/ talk to her which I simply won’t do. Today I took matters into my own hands and contacted Legal Aid, as well as taking a quick visit to my local police station. I am now filling out a Civil Claim and have a few questions regarding it, could you please answer as many of these as you can:
First of all: I’m 15 years old, so as a minor am I allowed to lodge this claim?
I was told by legal aid that I need 3 copies of the claim, one of which I have to deliver to my mother. Can I deliver this to her through registered mail?
One of the other copies is supposed to be lodged to my local court, but what do I do with the 3rd copy?
How much does it cost to lodge this Civil Claim? I think the lady from Legal Aid said it was 80 dollars, but I can’t exactly remember.
If my mother chooses to defend this claim in the local court, what do you think my chances are of winning? She argues that as my mother she has responsibility over the money, but I responded saying that I have a right to my own possession, and as a parent she doesn’t automatically gain ownership of me and everything I own. Also, I indicated to her that even if she is my parent, I’m never planning to contact her again, and you cannot have responsibility over the money of someone you will never see again. If a parental figure should have responsibility over the money, then why doesn’t my Dad have responsibility over it since he’s the one that I actually live with? I don’t really know how the local court will respond to this issue, help is much apreciated.

ok well my ex husband up & left me went overseas then called me told me f off loved another woman & that he didnt want nothing to do with his son as his new girl didnt want him to have anything to do with me or our son etc well that was 3 years ago . …i went to legal aid sbout 3 months ago (as i remarried & my husband wants my son take his name as we have 2 children together & he doesnt want my son to feel that he doesnt love him equal as my son only knows him as his dad meaning he wants to adopt him but i need to get full custody anyway as for things that needs father consent passport etc.. anyway i rang legal aid they told me i need to get full custody i explained to them that i cant as i dont know where he is… they then told me to send a letter to his sister who lives 30minutes from me (i only had her address as 3 years ago i deleted her number and all asi just wanted to forget my ex ) so i sent the letter saying could she get my ex to sign a stat declaration stating he gives me full custody etc.. well its been nearly 2 months & i havent recieved anything i know she still lives her at her address as i drove past to see ,, now my husband is telling me to go over there (to my exs sister house) & give her the stat declaration & tell her again to give to him so when we go back to legal aid we can say we told his sister by letter & face to face that i want full custody as my ex hasnt contacted or seen his son in 3 years & no reply & it could help us .. im lost at what to do me & my exs sister didnt leave on bad terms she is quiet nice (she was upset about the whole situation at the time ) i havent spoken or seen her in 3 years & i just dont want to bother her i know my ex has a different life now with his new wife maybe kids (as his friends that live here told me ages ago ) .. & i dont want to cause any dramas but im lost at what to do i need this paper this is my sons life … should i bite the bullet &go over there but what do you say after not seeing someone for 3 years & if she talks about my ex i could get emotional not that i love him anymore but he hurt me real bad (as when he left me all i wanted was answers .. what does everyone think i should do & if i do go any ideas on what to say etc.. .. thanks for everyones input
