My mother in law passed away in April this year and my father in law is terminally ill and will also pass away any time – probably a few months at best. My husband is an only child.

Because of how things are, my husband’s inheritance from the sale of his parents house etc., will be finalised this week. It will be between 0,000 & 0,000 (depending on how much the solicitor takes out for his fees etc.)

So my mother in law had said when I fell pregnant with my daughter (her first grandchild) that she was going to write into her will that she wanted ,000 set aside for my daughter as an inheritance. This was in 2005.

I was 10 weeks pregnant when she died and I presume she would have wanted the same for her 2nd grandchild also, so we will be setting up 2 trust accounts for each of her bio-logical grandchildren to receive when they are aged 21.

The question is though, is that I have 4 children from my first marriage, whom she treated as her own grandchildren and even made reference to them as her grandchildren in her last letter to us (she committed suicide).

We own our house outright already and have a successful business and no debts so the money is not really needed and we will probably invest it, so I was thinking that perhaps it would be nice to give the 4 other kids a smaller portion for their future.

We do not speak to my mother and their grandmother from my 1st husband only sees them a few times a year – so it was the only nana they knew and were heartbroken when she died.

Do you think it would be appropriate to give the other 4 kids say ,000 as well for when they are older from their nana?

I did ask my father in law what he wanted as really it is his money still, but he is too ill to understand us and did not answer.

I am worried that if I do give them money, at a lesser amount, they may be resentful that the 2 biological grandchildren got so much more, but they would be hurt to not be included as well.

And if we do this, should we tell them it’s what nana wanted so they feel like they were remembered?
My mother in law said back in 2005 that she wanted to do this to make it fair, as the 4 kids from my 1st husband would inherit from that side of the family so this way it would end up fair on all the kids, but my ex-husband does not even pay child support so the 4 kids wont get a cent anyway. She wanted it so it would be fair, not because she loved them any different.
Or should we give them all ,000 for their future and invest the other 0,000 (for our retirement).
It was actually my husband’s idea to give them all something. He treats them all as his own and just wants everyone to be happy and secure.
And my mother in law never actually wrote anything about it into her will, but because we know it’s what she wanted we are doing it.
My father in law has signed it all over to my husband now, so the payment is coming to my husband this week. We will be getting it before my FIL passes away.

    three years ago, I found out that my dad had purchased a property in mine and my brothers and sisters name (5 of us) without our permission. It is not known how he did it but it is suspected that he forged out signatures and then got the solicitor to sign on our behalf. My brothers and sisters attitude it great, we now have an investment property and do not want to sell because they say dad needs the rental money, but for me it means that my husband and I who have five kids are ineligible for the first home buyers grant (Australia only). My dad said that he set it up with the intent of putting money aside and it was a way for him to collect rental income. He also said that it may (and I mean may) be an inheritance. He did this in 1985, apparently documentation can be destroyed after 7 years. I do not have a relationship with my father, he is a short tempered rude man and tells me to mind my own business when I query how he managed to put this property in our name. He bought it outright at the time. Has this ever happened to anyone, have I got any rights?
    It really is our word against his. My dad has asked us to declare the rental income and "gift" him the money, I have refused as I don’t recieve a cent but my brothers and sisters who are all older than me are declaring and are now part of the scam. I have sought legal advice but it seems to have fallen into the "too hard basket". My dad bought the property when our mum died, he sold another property which he was supposed to keep as our inheritance to buy a property worth not very much and divided by 5 is now worth even less. I guess I just have to accept it, how do I sue?? I can’t prove anything, I have no paper work!!! plus they are all scared of dad, so my brothers and sisters won’t so anything and so am I!

      My mum passed away, a few months ago now, and my step family wont show me her will, mostly coz they know they wernt in it, but also coz they feel like shafting my brother and I.
      How can I get a copy, if probate hasnt been applied for, and I dont know the solicitors name.
      My mum left us a considerable amount of money, through life insurance, that I dont even know is valid, and my step family is trying to shame me out of my inheritance, by suggesting I only want to gain from my mothers death. ( sick bastards!!!! ) They’re also saying there is nothing in the will, the had no assetts, which I already know, but if there is no life insurance, why wont they show me?
      Any thoughts?

        Mum died. The executor (Public Trustee) did EVERYTHING wrong. I then started getting calls from relatives…harassing and hang up. Threats because I was supposedly going to court. I had not even seen a solicitor! All lies. Then a brother got a letter from a solicitor saying I had started legal procedings. I hadn’t. So I had to go to a solicitor after a year of this abuse.
        He did nothing much I asked about stopping the abuse. Seven months later, he, without my permission, applied for me to take the inheritance that my siblings (and I) were to share.
        I had always said NO COURT.
        Now solicitor is fired…madman…and I need help to undo a court matter that even the court house refuses to take off the list.
        If I proceed, with or without a solicitor, and loose, I have to pay all the legal fees that everyone accumulates. The looser really looses. The inheritance will be totally gone, and I will be in debt if this happens.
        This is URGENT.

        I’ve tried the phone book…it’s about 30 solicitors I’ve tried…not their field, not local enough, nasty, too expensive, can’t see the problem…you name it…..too many excuses why no one wants to fix a problem !
