My ex-wife treats my son like dirt. He is currently living in a very negative enviroment, and is sadly effecting his wellbeing. She screams and yells at him constantly, calling him names. He rings me in secret sobbing how he wants to live with. It is effecting his schooling and his guidance councillor agrees he needs to spend more time with me. At the moment a court order stands from 4 years ago for fortnightly sleepovers. I have tryed resovling this issue through Relationships Australia, but she will not discuss this. This is now at breaking point, with my 11 year old son constantly miserable, and even made worse by his mother when he tells her he wants to spend more time with me. Someone told me that an 11 year old can hire a solicitor (with legal aid) to represent him in wanting to be with me. Has anyone heard of this before??

An eleven year old can not enter in to a legally binding contract with any one.
The real issue here is why you do not try real hard to get custody of your son if he is being neglected so badly. If what you say is true, and just by this I have no reason to doubt you, then it wont be long until child welfare intervenes and rightly so. Do something before this happens, once the government gets involved you have a whole other problem.
