"Under 0.5" is what we are told about alcohol. What perameters are the police working with when testing for marijuana ? For that matter, what are the driving restrictions for marijuana in the ACT where marijuana is legal to consume?
I feel that we are given little info about this in the hope that the police will "catch us out". I personally know many people (doctors, solicitors, school teachers, policemen) who use MJ recreationally, but my concern is with paliative care patients and my chronically ill partner who use the drug as an irreplaceable aide for pain relief/appetite & sleep. I have addressed this issue with many and have found out that people WILL continue to use it in the hope that one day soon MJ will be made legal.
Legalise it. Tax it. Regulate the strength. Whatever it takes, just don’t penalise us for using this age-old aide.
At least inform us of the testing procedure so we can avoid beurocratic penalties.

    If police pull someone over and suspect the driver is impaired with drugs while driving, it doesn’t matter whether the driver drove home from a wild night of smoking joints, or was taking a legal form of the drug such as Marinol. If the police can build a solid enough case with sobriety tests and the blood test results, a DUI could result either way!

    Police usually order a blood test done when they suspect a DUI, whether there is alcohol or drugs involved. Marijuana can be detected in the blood for up to 24 hours from when it was smoked. Marijuana doesn’t stay in the blood for weeks as it does in urine. Police can’t bust you for a DUI with the results of a urinalysis or a hair test. Blood tests are what the police will most likely use in court. So if you want some "parameters" – after 24 hours you are pretty much safe from getting a DUI as the result of smoking marijuana or taking a legal derivative.

    I can only give you the California answer, though I would suspect it’s the same in all states.

    There is no "legal threshold" of marijuana for a driver in this state – that is to say that there is no level per se at which you are or are not guilty of a crime.

    What there is, however, is a law that says if you drive while under the influence of *any* drug, and if your driving is impaired by that drug, you are guilty of DUI. So if one toke on a joint causes you to swerve all over the place and crash into parked cars, you’re guilty of DUI. If you can smoke a bowlful and drive with the best of ‘em, you’re home free.

    Your paranoid assertion that the police want to, "catch us out" couldn’t be further from the truth in my state. The only way to "catch you out" is for you to start driving like an idiot when you’re high…hardly something we have any control over.

    You want to know the testing procedure? Simple…are you driving with your head where it doesn’t belong because you’ve been smoking weed? If so, you just failed the test.
