I got pulled over since my tail lights had gone out (faulty fuse, Bad timing) I had hotboxed a couple of joints earlier in the day and the car still reeked. The cop smelled it and arrested me asap and searched the car. I had no weed so I thought i was ok. The car i was in was only a couple days old. So when he searches the car he finds baggies under my passenger seat carpet and a digital scale hidden in my trunk. (I let him search it since I had nothing to hide, but some one previously had hidden it deep in there) The officers then scraped some crumbs off the carpet and said since it was enough to test it was enough to charge me with for possesion of it. He gave me paraphanelia for the scale and baggies. Ontop of my traffic ticket. I have never been arrested so the whole thing was scary. I was scared because im going to be a future college student and marijuana possesion will make you lose your financial aid in the states. (i live in washington). They told me the only way out was to
Was to exchange another crime for the one i had commited. Me being afraid made up a lie about an buddy who i knew who knew some one who sold weed at my college. (No lie thats exactly what i told the cops) Then the officer said that would work and i think what i sighned was a deposition. I was released later that night. He said id have until nov 1 to find out who the mystery drug dealer was. I just want my ticket and to go to court. I dont know what to do and am still kinda confused. I remeber him saying that after november 1st if i had not done what i was supposed to the ticket would just be turned into wherever tickets go when they get turned in. I just dont wanna lose my fafsa school money over some crumbs. I dont know what I should do. Any helps appreciated thanks.

The search is valid under Carroll Doctrine. You yourself admitted to smoking weed. The officer found some, plus can testify to the odor in the car, and can show the scales and baggies. If you plead not guilty they will have a trial. They try cases every day. I have no idea why the poster above says they won’t. If you don’t believe me go over to District Court one day and watch it. The judge won’t believe that the scales and bags in your car are not yours unless he/she is a total fool. Go hire a lawyer or get one appointed to you if you qualify.

Plead not guilty and go to trial. they never go to trial,, and will drop the case on the day of the trial,,, if you hold to your story of the items not being yours… they will bullshit you saying they want jail time but you wont get any.. even if your found guilty.. don’t sweat it. call their bluff … you don’t need a lawyer… it costs the court thousands of dollars to hold a trial .. over a speck of weed ? I don’t think so… Hold to your story and the prosecutor will bluff you.. but will back down the morning of the trial ..
edit I live here in Washington,, the courts are bogged down and they are really not interested in weed posesion anymore..

oh and if you think getting arrested is scary – think of how a 16 yo female in sw oklahoma felt when she ran head on into a bridge in the middle of the night after leaving a party and doing illegal drugs and drinking. it wasn’t bad enough that this young girl ran head on into the bridge….she landed in a fire ant bed and because of her injuries and the drugs, was unable to move. by the time one of the locals saw her truck come daylight and found her, she was so completely covered in fire ants that she was unrecognizable. the worst part? she was still alive. she died on the life flight to the hosptial. so you know what? i have no sympathy for YOU.
If I were you I would get an Attorney , if the scales and baggies were not yours then have him insist on gettig them printed , if there are prints on the items (not yours ) then you may have a case , I do not think they can procede with what you are calling a few crumbs , but hopefully you have learned a valuable lesson …..
Just remember if there are NO prints on the items then they still have a case as you were in possesion of the items.
