I got arrested and charged with offensive behaviour and hinder police in May. To cut a long story short my mate got punched by a bouncer and I called the cops. The cops ended up arresting me and my mate (the one that got punched). They used excessive force – my mate is only about 50kgs and 4 cops + 1 bouncer jumped on her! We spent the night in lock up and had to go to court. We both pleaded not guilty so the judge ordered the cops to put together a brief and hand that to my solicitor by 4pm tomorrow. I was meant to have a meeting with my lawyer at 4pm tomorrow to go over the brief. But my lawyer just called and said the cops won’t have the brief in on time. What happens from here? The judge ordered the brief be received by that time but now the cops are not upholding that….is it likely that my charges will get dropped and case thrown out of court?

No, not necessarily. In the legal system unfortunately things get delayed all the time for all sorts of reasons-they may have applied for an extension of time, orhave just communicated with your lawyer.
The charges getting dropped would be a dependent on whether there’s sufficient evidence-if the police, when putting together the brief, decide they can’t make out a case, then they might drop the charges.
I’d recommend asking your lawyer what they think will happen next-there are things that can be done if the police continually delay proceedings.
yes it will be dropped but I would sue them.
Just because the brief is late doesn’t mean that matter won’t/can’t be heard. It may simply lead to an adjournment of the matter.
