Legal question: Do I need to apply for a Section 10 or will a magistrate rule that way?

I have an upcoming court case (traffic matter) & am wondering if I need to apply for a Section 10 through my Solicitor or will a magistrate suggest that this is best way to deal with my case?
Court is in NSW, Australia.

Why put your trust in the arm of the person who might wind up having a bad day and decide to take it out on anybody they can?

If it can benefit your case, just do it.
