Is it legal for phone solicitors to send you advertising text messages at 1:30am?

I woke up last night to a text message at 1:30am saying: Can’t make your mortgage payment. Take advantage of U.S. Government assistance. Cut your payment in half! Visit www.modify4loan.com today!

Is this legal?

    in australia there is a ‘do not call’ register where it is illegal to call someone who has registered that they do not want unsolicited calls.
    don’t know if it applies to texts and i don’t know if there’s one in america….
