We signed a contract last year for a house. The buyer had also signed the contract (section 32). Now he claims it was not his intention to sell and will not sell to us even though we have a signed contract. He says he doesn’t speak English and did not understand and did not agree to sell us the house. We are taking him to court but just wondered if any legal people out there might know of a way he might get out of it that we haven’t thought of. Out solicitor says he is fairly confident we will win but I dont like surprises.

Are you thinking about selling your home yourself? then
I am not a lawyer, so you’ll have to seek professional help with this, however if the contract is valid, while you may not be able to force the sale of the house, you may well have legal recourse to recover damages for breach of contract.
fire your lawyer…you hired a lawyer and now ask idiots on yahoo. what the fu-ck do you need to pay a lawyer for when you can get all the answers here for free.
