there is no contract and I have enough proof to show that the money was lent but the problem is proving he works as he gets cash in hand and has no assests. He is a subcontractor and want to know how to go about getting a subpoena to get his books to show he works or his bosses books without having a lawyer, the amount he owes is over ,000 and I havve all ready spoken to legal aid, just have to get proof that he works.

in Australia you can go directly to your local courthouse and see the magistrate who will have a bailif serve him with papers to make him pay.
They will then take it before the court and you both get to plead your case.
Then, he will have the option of payiing in one lump sum or in installments – which he will probably do – these installments can be anywhere from 5% to 30% of his net weekly income.
If however you feel that he is ripping the system off by earning cash in hand – you can then bring him and any/all employers down with him by speakiing to the ATO.

You probably should hire an attorney so you can have your case reviewed and then can have subpoenas issues and such. I think $10,000 is beyond small claims so it would go in front of a Judge instead of the small claims court.
