My dad died only recently. We have already sorted out bank accounts etc. We have not discovered that the property was not under joint names with my mum, but are under his name, as a sole owner.
We were told, that we need to apply for a "Probate".
Can anyone advise is this the way to go, or do we just need to see a solicitor? or do we have to apply for a probate and see a solicitor?
We live in the UK, so any answers please uk specific. Thanks
He had made out a Will stating that my mother inherits everything.
So is everything the same, e.g. needing probate etc

  1. If your father did not leave a will giving the home to someone other than your mother, there is something called Dower Rights that may apply. It states that even if a spouse puts no money into the home, the law gives her the right to live in and share the property. These rights are called Dower Rights and come into effect on the death of one of the owners (father) So the house basically becomes hers. even if she is not listed as a joint owner. You should contact a solicitor to have the deed transferred into your mothers name. If the will is not contested, there shouldn’t be any problems. If someone dies without a will and has assets the court usually rules as to who gets what. All outstanding debts/mortgages/etc are paid first. So yes your fathers estate will have to go through probate.
