I am giving serious thought to separating from my partner of 12 years and get custody of my children since we have been arguing and fighting a lot lately, particularly over money matters and disciplining the children.

The way Domestic Violence Crisis Service, Legal Aid Office and Womens Legal Assistance explained it to me makes it seem easy but is it? I thought I’d seek out comments from others who have been through the court process and find out what their experience was like.

  1. Is your husband physically abusing you or threatening you?
    I have been through this. If he does either of these two things, call the police! They will give an interim order and the both of you will have to appear in court at a date to be determined. The magistrate will ask if you wish to proceed with an AVO and then it’s up to you. Hint.! don’t waste the courts time if you are not sure. The day i got mine 4 women changed their minds and it really upset the magistrate. Don’t be afraid, I know it’s scary, but there are support people there to help you. Good luck!!

    Sorry to hear about your position. Try the site below for research on this issue, make sure to change the location/state in which you reside.
