Can I sue a Dr?

My husband’s ex tried to take out a protection order. The evidence she used was actually forged so the case was dropped. However unbeknown to us, she went to see a Dr, the Dr was physicatrist, My husband’s ex was seeing her about 14yrs ago. The Dr actually wrote a letter to the courts trying to get them to enforce the order stating that my husband was sexually abusing and was stalking and harassing his ex. We knew of this letter when it was sent to us via the child support agency, my husbands ex sent it to them use as evidence to show my husband was unstable. As my husband had not seen the Dr, we hired a solicitor to write and ask why the Dr wrote the letter, her reply was I made a mistake and it was actually somebody else I was referring to. We have paid all our solicitor fees for the letters, not to say the embarassment this has caused, nobody has asked the ex to give the letter back, nobody has done anything

      If you want to pay out more fees go to your lawyer but they’re the one’s that will be the winners.
      Just forget it all and get on with your lives or move to another town.

    5. I would say yes… Contact a lawyer, they will tell you if you can get anything out of it… Try to find one of those "ambulance chaser" lawyers that only get paid if you get a settelment… Those guys are ruthless!!

      Well thankfully that evidence didn’t lead to his incarceration.

      You could sue the doctor for defamation of character but as the doctor did not actually intend for the letter to cause harm I doubt you would win.

      Given the circumstances you are probably just S.O.L. It can’t hurt to make an appointment with a lawyer and see what’s up.

      If the solicitors fees are something you can handle, you need to think about the consequences of continung this.

      From this question I can’t speculate as to the stress on your relationship from all this, but I would imagine there is some.

      Yes you can sue the doctor. Among other things, you can sue the doctor for defamation of character and I doubt there is a court in this country that would not agree with you. I would also sue his ex for slander.

    8. Oh heck yes you can. Though the Dr will probably settle out of court.. Still you and your husband are entitled to compensation.
