I live in a Victorian semi, built 1905. The brick wall in the back garden has recently collapsed. I’ve contacted our solicitor who has confirmed that it is a joint party wall.
Our neighbour says that he does not want to pay for any of the repair (£7,000 in brick), as it is our responsibility as we recently had an extension built and he contends that this is why it has collapsed. However, the wall (and all the other walls of the garden) was absolutely knackered – the mortar had turned to dust, bricks were crumbling, the wall was leaning right over and you could just lift bricks out of the wall. It was very dangerous.
I have two questions:
How can we get him to pay half towards the cost of repairing the wall?
Can we replace the brick wall with a fence (which would only cost £1,000) if he point black refuses to contribute, or do we have to replace like with like?
