My ex and i came to an agreement in mediation through our solicitors. I signed the copy on the day and i was told i had to come back to sign the final copy that goes to the judge. My ex has broken the agreement in only a few weeks of having it and i still havent signed the final copy that goes to the judge. What happpens if i refuse to sign it? will it go back to mediation or go to court? my son is only a year old and ever since having supervised visits with him he is haveing a really hard time. He is extremly clingy and doesnt want to sleep on his own which he has NEVER done. I have a dvo out against him also.

    1. before it goes to court – and if both parties dont sign the mediation papers, it will more than likely end up with the courts, both parties will have it suggested to them that they really try hard to settle this out of court. As it will only create costs for you both if you cannot settle out of court.

      Your soon to be "x" gets a Lawyer and takes it before a Famili Court Hudge. The judge them makes all the decisions instead of you two.

      Depends on what you signed to start the mediation, I would guess. If you said you would obey the mediation and you signed the draft, then you are breaking the agreement by not signing the formallity of the copy for the judge and it can go against you. Perhaps you can sign it and underneath "Signed under protest" Present your ex’s violations to the judge.

    4. Absent a signed agreement, the Court will make an order whether the two of you agree or not.
